Meet Your Attorney
Your business and reputation deserve a lawyer who has been there before.
When a contractual promise is broken or a business partner breaks your trust, the damage often goes beyond the contract. It can impact your company’s operations, your employees, and the reputation you have spent years building. Many of our clients come to us after someone they trusted has failed to meet a contractual obligation or seeks to take advantage of the client due to changing circumstances, perceived economic advantage or greater financial resources. Mark Wendorff has built a career in successfully litigating those disputes.
Complex business disputes and well-funded adversaries do not intimidate Mark. As lead counsel he has secured favorable settlements and results through trial, binding arbitration and appeal in California and Nevada, which include:
- Judgment for Release of $28.8 million for full recovery of money withheld from his client through stop notice on a $124 million Caltrans bridge project.
- $19 million Judgment after trial for full recovery of money owed to his client on a $530 million hotel and resort project, affirmed on appeal by the Nevada Supreme Court.
- $16.5 million Judgment after trial for full recovery of money owed to his client on a $2.3 billion hotel and resort project, affirmed on appeal by the Nevada Supreme Court.
- Defense Award against a $4 million claim after binding arbitration denying the entire claim against his client on a purchase and sale agreement dispute regarding his client’s acquisition of a corporation.
- Negotiated Settlement for $2 million of insurance coverage from two insurance carriers on a litigated first-party insurance coverage dispute for defense and indemnity of his client against $2.4 million in construction defect claims on a commercial construction project.
- Negotiated Settlement of $1.25 million for full recovery of money owed to his client on public works project, plus a dismissal and written retraction of the public agency’s claims against the client in litigation.
- Judgment at trial against a $250,000 bid bond claim against his client by a public agency on a public works project, affirmed by the California Court of Appeals.
- Negotiated Settlement of $167,000 after obtaining a writ of attachment for full recovery of money owed to his client on a sale of raw materials to a manufacturer.
- Judgment at trial against the U.S. Secretary of Labor on a disputed federal OSHA citation.
A business mind, not just a legal one.
Before becoming a lawyer Mark spent six years working in the business world. He worked in commercial finance at McDonnell Douglas Finance Corporation, in corporate accounting and insurance, and as a licensed investment broker. He also drafts and negotiates the same type of agreements that he litigates.
Mark looks at the big picture and gains an understanding of the disputed transaction from the perspective of the business owner client. You will hear straight answers about the strengths and weaknesses of your case, your risks, and your realistic options. Mark will work with you to prepare your case with a goal of creating leverage for a favorable resolution before trial commences or to secure a favorable judgment at trial.
